TazamaFans — Terms of Service

1. Definitions

“Viewer” means any registered user who accesses Creator Content on the Platform.

“Viewer Wallet” means the electronic balance maintained by the Platform for Viewer deposits, tips and refunds.

“Subscription” means a recurring or one-time payment granting access to Creator Content for a specified period.

“Virtual Tips” means voluntary payments made by a Viewer to a Creator.

2. Eligibility & Account Registration

You must be at least 18 years of age to register as a Viewer and to use the Platform’s paid services.

You are required to provide accurate registration information and keep your contact details up to date.

You are responsible for maintaining the security of your login credentials and for all activity on your account.

3. Access to Content

Viewers may access free and paid Creator Content in accordance with the terms published by each Creator and these Terms.

Payments grant a limited license to view content; title and intellectual property rights remain with the Creator.

Recording, redistributing, re-selling, or otherwise exploiting Creator Content without express permission is strictly prohibited.

4. Deposits, Payments & Refunds

Deposits into your Viewer Wallet are final and non-refundable except where required by law or as expressly provided in these Terms.

By depositing funds or making payments you authorise TazamaFans to charge your chosen payment method and to apply funds to purchases on the Platform.

Purchases of Content and Services are final. Refunds will only be provided in limited circumstances (e.g. demonstrable technical failure preventing access), at the Platform’s discretion or as required by law.

Initiating a chargeback or an unlawful payment dispute may result in immediate suspension, recovery action and reporting to relevant authorities.

5. Withdrawals

Viewers may withdraw unused Viewer Wallet balances subject to a withdrawal processing fee of 10% of the withdrawal amount.

Withdrawals are processed through approved Payment Providers and may incur additional service provider fees. Withdrawals will generally be processed within 1–3 business days.

Funds which have been used to purchase Creator Content are not withdrawable; such funds are final upon the Creator’s receipt as determined by the Platform.

6. Community Standards & Conduct

Viewers must not harass, intimidate, or threaten Creators or other users. Abusive conduct, hate speech, stalking, and doxxing are strictly prohibited.

Viewers must not solicit illegal acts, attempt to coerce Creators into providing services that violate law or community standards, or engage in fraudulent behaviour.

7. Intellectual Property

Creators retain ownership of the content they upload to the Platform, subject to the license granted to the Platform to host, display, and distribute such content as necessary to provide the Services.

You must respect the intellectual property rights of Creators, the Platform, and third parties. Unauthorized copying, reproduction, public performance, distribution, modification, or commercial exploitation of Creator Content or Platform materials is strictly prohibited.

All rights, title, and interest in and to the Platform, including its trademarks, logos, software, and design, remain the exclusive property of the Platform and may not be used without prior written permission.

Alleged infringement should be reported to the Platform in accordance with the procedures set out in the Platform’s Copyright Policy.

8. Indemnity

You agree to indemnify, defend, and hold harmless TazamaFans, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: (i) your access to or use of the Platform; (ii) your violation of these Terms; or (iii) your violation of any rights of a third party, including intellectual property or privacy rights.

9. Platform Rights

The Platform reserves the right to suspend, restrict, or terminate Viewer accounts for violations of these Terms or in response to suspected fraudulent or illegal activity.

The Platform may change, add or remove features, pricing or functionality at its discretion. Where such changes materially affect Viewer rights, the Platform will endeavour to provide reasonable notice.

10. Limitation of Liability

TazamaFans provides the Platform on an “as is” basis and disclaims all warranties, to the maximum extent permitted by law.

Under no circumstances will TazamaFans be liable for indirect, incidental, special or consequential losses (including lost profits, data loss, or loss of business) arising out of or in connection with the Platform.

11. Force Majeure

TazamaFans will not be liable for delay or failure to perform obligations caused by events beyond its reasonable control, including but not limited to a force majeure event.

12. Termination

You may close your Viewer account at any time through account settings. Termination does not affect accrued obligations or rights arising prior to closure.

The Platform may terminate or suspend your access immediately upon breach of these Terms or where required by law.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.

Disputes shall first be attempted to be resolved amicably between the parties. If not resolved, disputes shall be referred to binding arbitration in Nairobi, Kenya.

14. Entire Agreement & Severability

These Terms (together with the Privacy Policy and other incorporated policies) represent the entire agreement between you and TazamaFans in relation to the subject matter herein.

If any provision is held invalid, the remaining provisions remain enforceable.
